Nach der Aufdeckung der neonazistischen Terrorzelle „NSU“ und dem´Bekanntwerden einer schier endlosen Kette von „Ermittlungspannen“ ist vor allem der Verfassungsschutz in die tiefste Legitimationskrise seiner Geschichte geraten. Die politisch Verantwortlichen reagierten darauf aber nicht etwa mit dessen Infragestellung, sondern mit weiterer Zentralisierung und Vernetzung verschiedener „Sicherheitsbehörden“: Mitte November 2012 wurde das „Gemeinsame Extremismus- und Terrorismusabwehrzentrum“ eröffnet. Auch hat der Verfassungsschutz inzwischen, von der Öffentlichkeit kaum bemerkt, polizeiähnliche Befugnisse erhalten. In Bayern ist das Landesamt für Verfassungsschutz u.a. durch den Einsatz von „Staatstrojanern“ zur Ausforschung von Computern in Erscheinung getreten. Ist das alles noch mit Recht und Gesetz sowie mit den Prinzipien einer demokratischen Gesellschaft vereinbar?<\/p>\n

Als Konsequenz wird von vielen die Abschaffung des Verfassungsschutzes gefordert – andere wiederum halten diese wegen des Unterlaufens des „Trennungsgebots“ für schädlich und eine radikale Reform für erforderlich. Dieses Streitgespräch bietet eine Gelegenheit, sowohl die Begründung der beiden Positionen als auch kritische Stellungnahmen kennen zu lernen.<\/p>\n

Prof. Dr. Martin Kutscha,<\/b> geboren 1948 in Bremen, lehrt Staats- und Verwaltungsrecht an der Hochschule für Wirtschaft und Recht in Berlin. Er ist durch zahlreiche Veröffentlichungen insbesondere zu Grundrechts- und Verfassungsfragen hervorgetreten, u. a. als Mitautor des Lehrbuchs „Verfassungsrecht konkret“ sowie als langjähriger Mitherausgeber des jährlich erscheinenden „Grundrechte-Reports“.<\/p>\n

Dr. Klaus Hahnzog,<\/b> geboren 1936 in Stuttgart, ist Jurist. Er ist nichtberufsrichterliches Mitglied des Bayerischen Verfassungsgerichtshofs und war viele Jahre Mitglied des Bayerischen Landtags (SPD). Dort engagierte er sich für Verfassungs-, Rechts- und Parlamentsfragen. Zuvor war Hahnzog Kreisverwaltungsreferent der Stadt München, Stadtrat und Dritter Bürgermeister. Er engagierte sich besonders auch in der Arbeitsgemeinschaft sozialdemokratischer Juristinnen und Juristen, deren Bundesvorsitzender er für mehrere Jahre war.<\/p>\n
