Im so genannten Brokdorf-Beschluss hat das Bundesverfassungsgericht 1985 klar gestellt, dass die Gewährleistung der Versammlungsfreiheit ein zentrales Merkmal unserer Demokratie ist. In der Praxis der Voranmeldung und Durchführung von Demonstrationen wird dem jedoch immer weniger Beachtung geschenkt. Den Organisatoren von Demonstrationen werden mehr und mehr Auflagen auferlegt, der Ablauf der Demonstrationen wird zahlreichen Einschränkungen unterworfen. Derlei Einschränkungen können – wie in Heiligendamm 2007 – nahezu einem Demonstrationsverbot gleichkommen.<\/p>\n

Der Rechtsschutz gegen die Einschränkungen des Versammlungsrechts gestaltet sich immer schwieriger, da:<\/p>\n

    \n
  • die Durchsetzung des Versammlungsrechts finanziell aufwändig ist<\/li>\n
  • der Zeitdruck, unter dem die gerichtlichen Entscheidungen zur Zulassung von Demonstrationen stehen, oft dazu führt, dass die Gerichte auf die gefahrenbezogenen Darstellungen der Polizei vertrauen (z.B. Entscheidung des Bundesverfassungsgerichtes bezüglich des Sternmarsches nach Heiligendamm im letzten Jahr). <\/li>\n<\/ul>\n

    Hinzu kommt, dass auf der gesetzlichen Ebene seit den 70er Jahren eine kontinuierliche Einschränkung des Versammlungsrechts stattgefunden hat, die mit der Verhinderung von Neonazi-Aufmärschen legitimiert wurde. Nach der 2006 vollzogenen Förderalismus-Reform sind nun die Bundesländer für das Versammlungsrecht zuständig, ein weiterer Wettbewerb der Einschränkung der Versammlungsfreiheit steht zu befürchten.
