Die Diskussion um die verfassungsrechtliche Einordnung des neuen Computer-Grundrechtes konzentrierte sich auf die Frage, wie dessen objektivrechtliche Begründung im Verhältnis zu den traditionell subjektiv formulierten Abwehrrechten zu bewerten sei. Ein Vorteil jener Abwehrrechte sei es, dass man damit eine Definition gesellschaftlicher Freiheit vermeiden könne, was mehr Platz für unterschiedliche Vorstellungen individueller Freiheit lasse.<\/p>\n
