Da<\/span><span dir=\"ltr\" role=\"presentation\">hilft als letzter verzweifelter Versuch nur noch das Strafrecht! Ein Straftatbestand des \u00d6kozids muss <\/span><span dir=\"ltr\" role=\"presentation\">her. <\/span><\/span><span id=\"page3R_mcid66\" class=\"markedContent\"><\/span><span id=\"page3R_mcid67\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Wir wollen uns dieser Forderung von der grunds\u00e4tzlichen Aufgabe und den Zwecken des Strafrechts <\/span><span dir=\"ltr\" role=\"presentation\">her n\u00e4hern und sodann die Spezifika<\/span> <span dir=\"ltr\" role=\"presentation\">des Umweltstrafrechts in den Blick nehmen. Denn ein <\/span><span dir=\"ltr\" role=\"presentation\">kategorisches Verbot der Nutzung der Umweltg\u00fcter kann es nicht geben, es bedarf eines <\/span><\/span><span id=\"page3R_mcid68\" class=\"markedContent\"><\/span><span id=\"page27R_mcid0\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Verteilungsprozesses, bei dem fairerweise auch k\u00fcnftige Generationen ein W\u00f6rtchen mitreden <\/span><span dir=\"ltr\" role=\"presentation\">sollten. Hieran ankn\u00fcpfen<\/span><span dir=\"ltr\" role=\"presentation\">d stellt sich die schwierige Frage, wie ein Straftatbestand des \u00d6kozids<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">konkret auszugestalten w\u00e4re, um erstens Wirkmacht zu entfalten und zweitens den Bedingungen <\/span><span dir=\"ltr\" role=\"presentation\">des Strafrechts gerecht zu werden.<\/span><\/span><span id=\"page27R_mcid1\" class=\"markedContent\"><\/span><span id=\"page27R_mcid2\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><\/p>\n<p><span id=\"page27R_mcid2\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Hier k\u00f6nnen wir sowohl auf nationale Vorbilder als auch<\/span> <span dir=\"ltr\" role=\"presentation\">auf einen Vorschlag der Ecocide Foundation <\/span><span dir=\"ltr\" role=\"presentation\">Bezug nehmen und zudem auf die durchaus ambivalente Geschichte des V\u00f6lkerstrafrechts blicken. <\/span><span dir=\"ltr\" role=\"presentation\">Und die generelle Frage bleibt: Ist der Ruf nach dem Strafrecht in einer solch prek\u00e4ren Situation <\/span><span dir=\"ltr\" role=\"presentation\">legitim, wenn man ans<\/span><span dir=\"ltr\" role=\"presentation\">onsten wenig von ihm h\u00e4lt?<\/span><\/span><span id=\"page27R_mcid3\" class=\"markedContent\"><\/span><span id=\"page27R_mcid4\" class=\"markedContent\"><\/span><\/p>\n<p><span id=\"page27R_mcid4\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">Zur Person:<\/span> <span dir=\"ltr\" role=\"presentation\">Prof. Dr. Roland Hefendehl ist seit 2004 Inhaber des Lehrstuhls f\u00fcr Kriminologie und <\/span><span dir=\"ltr\" role=\"presentation\">Wirtschaftsstrafrecht an der Universit\u00e4t Freiburg und Leiter des gleichnamigen Instituts, aus dem <\/span><span dir=\"ltr\" role=\"presentation\">eine Vielzahl von Forschungsarbei<\/span><span dir=\"ltr\" role=\"presentation\">ten und Projekten zu Grund und Grenzen des Strafrechts sowie <\/span><span dir=\"ltr\" role=\"presentation\">dessen gesellschaftlicher Bedeutung hervorgegangen ist.<\/span><\/span><span id=\"page27R_mcid5\" class=\"markedContent\"><\/span><span id=\"page27R_mcid6\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><\/p>\n<p>&nbsp;<\/p>\n<p><em><span id=\"page27R_mcid6\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Die Teilnahme an der Veranstaltung ist wie immer kostenfrei.
