Probleme der Priorisierung und ihre Gefahren f\u00fcr Menschenrechte"},"content":{"rendered":"<p>&#8222;Niemand darf wegen seiner Behinderung benachteiligt werden&#8220;, hei\u00dft es im Artikel 3 des Grundgesetzes. Besonders in Zeiten von Katastrophen und Krisen ist die Gleichbehandlung von Menschen mit Behinderungen jedoch in Gefahr. Darum hat das Bundesverfassungsgericht (BVerfG) am 28. Dezember 2021 im Zusammenhang mit der Corona-Pandemie dem Gesetzgeber auferlegt, &#8222;unverz\u00fcglich&#8220; rechtliche Ma\u00dfnahmen zum Schutz behinderter Menschen zur Vermeidung ihrer Diskriminierung in Situationen von &#8222;Triage&#8220; zu erlassen.<\/p>\n<p class=\"\">Diese Entscheidung wie auch der am 24. August 2022 vom Bundeskabinett dazu beschlossene gesetzliche Entwurf war f\u00fcr die Humanistische Union der Anlass f\u00fcr eine kritische Diskussionsveranstaltung. Der Marburger Oberb\u00fcrgermeister Dr. Thomas Spies \u00fcbernahm die Schirmherrschaft.<\/p>\n<p>Ziel der Diskussion war eine diskursive Verst\u00e4ndigung \u00fcber menschenrechtliche Mindestanforderungen sowohl an eine &#8222;Triage&#8220;, als auch bereits im Vorfeld an Krankenversorgung und Pflege. Wichtig war dabei auch die Frage, wie das Gesundheitssystem aus der neoliberalen Umklammerung gel\u00f6st werden und als lebenswichtige Infrastruktur unter den besonderen Schutz der Allgemeinheit wie auch des Staates gestellt werden kann.<\/p>\n<p>Wissenschaftliche Vertreter*innen der Fachgebiete Recht, Philosophie und Ethik, Medizin und Sozialwissenschaften kamen mit Betroffenen einer drohenden Ausgrenzung und mit Interessierten ins Gespr\u00e4ch.<\/p>\n<p>Am Podium nahmen teil:<\/p>\n<ul>\n<li>Prof. Dr. J\u00f6rg Arnold, Strafrechtswissenschaftler und Forschungsgruppenleiter am Max-Planck-Institut zur Erforschung von Kriminalit\u00e4t, Sicherheit und Recht, Freiburg i.Br.<\/li>\n<li>Dr. Florian Grams, Historiker, Publizist und Behindertenaktivist, Hannover<\/li>\n<li>Gisela Lind, Pflegefachkraft und Betriebsr\u00e4tin des Universit\u00e4tsklinikums Gie\u00dfen und Marburg (UKGM), Marburg<\/li>\n<li>Dr. med. Kai L\u00f6wenbr\u00fcck, Facharzt f\u00fcr Neurologie, Intensivmedizin und Geriatrie, Universit\u00e4tsklinikum Carl Gustav Carus, Dresden<\/li>\n<li>Prof. Dr. Rosemarie Will, Professorin i.R. f\u00fcr \u00d6ffentliches Recht, Staatslehre und Rechtstheorie an der Humboldt-Universit\u00e4t zu Berlin, ehem. Verfassungsrichterin des Landes Brandenburg, ehem.
