Eine solche Argumentation teilt jedoch die grunds&auml;tzliche Schw&auml;che aller utilitaristischen Begr&uuml;ndungen, so Reinhard Merkel. Hierbei w&uuml;rde die Aufrechterhaltung einer objektiv-normativen Ordnung &uuml;ber die Interessen des Einzelnen gestellt&nbsp;&#8211; eine Sichtweise, die mit dem Freiheitsverst&auml;ndnis des Grundgesetzes schwerlich vereinbar ist.<br \/>\nDennoch sprach sich Merkel in seinem Vortrag &uuml;ber &#8222;Die Notwendigkeit der strafrechtlichen Ausgestaltung von Sterbehilfe&#8220; f&uuml;r eine Aufrechterhaltung des Verbots aus. Das Verbot erf&uuml;lle jedoch einen anderen Zweck, als gemeinhin angenommen: Der Sterbewillige solle damit vor seiner eigenen, m&ouml;glicherweise &uuml;bereilten Entscheidung gesch&uuml;tzt werden.
