Die heute erschienene Contact-Tracing-App ber\u00fccksichtigt die Forderungen von Zivilgesellschaft und Wissenschaft hinsichtlich Privatsph\u00e4re und Datenschutz weitgehend. Dennoch bleiben wichtige Fragen offen.<\/i><\/p>\n

In den letzten Wochen ist die Einführung einer Tracing-App in Deutschland heftig diskutiert worden. Bürgerrechtsorganisationen wie die Humanistische Union forderten Freiwilligkeit bei Installation und Nutzung der App sowie bei der Benachrichtigung anderer Personen im Fall einer Infektion. Zu den weiteren Forderungen gehörten Datensparsamkeit und Anonymisierung, dezentrale Speicherung, die Offenlegung des Quellcodes aller Komponenten und die Anwendung des Datenschutzes (so z.B. in einer Pressemitteilung der Humanistischen Union<\/a>). Den Einwänden der Organisationen wurde zum Großteil Folge geleistet. Trotzdem bleibt vieles unklar:<\/p>\n

Wie freiwillig kann freiwillig sein?<\/span><\/h2>\n

An sich ist die Nutzung der App freiwillig und beruht auf der expliziten Einwilligung der Nutzer*innen. Aber es ist denkbar, dass die Teilhabe am öffentlichen Leben von der Nutzung der App abhängig gemacht wird. So könnten Betriebe ihre Verwendung von ihren Mitarbeiter*innen fordern, bzw. die App gleich auf den Diensthandys installieren. Oder der Eintritt in Restaurants, Museen, Geschäfte etc. wird vom Vorzeigen der App abhängig gemacht.<\/p>\n

„Es muss unbedingt sichergestellt werden, dass jemand, der die App nicht nutzt, keine Nachteile erfährt“, <\/i>so die Datenschutzexpertin der Humanistischen Union, Christiane Bodammer. „Es muss ausgeschlossen sein, dass Personen, die die App nicht nutzen wollen oder können, Nachteile erleiden. Jede auch nur mittelbare Einflussnahme auf die Nutzer*innen – auch durch Vorteilsgewährung – muss ausgeschlossen werden.“<\/i><\/p>\n

Eine Evaluation ist unabdingbar<\/span><\/h2>\n

Noch ist unklar, ob die App tatsächlich ihren Zweck, nämlich die Eindämmung des Coronavirus, erfüllen kann. Die Antwort auf diese Frage ist aber entscheidend: Wenn die Nützlichkeit der App begrenzt ist, steht auch ihre Verhältnismäßigkeit infrage – und damit ihre Zulässigkeit angesichts der Risiken. „Die Humanistische Union fordert daher eine zeitnahe Evaluation des App-Einsatzes“,<\/i> sagt Christiane Bodammer.<\/p>\n

Fehlende gesetzliche Regelung<\/span><\/h2>\n

Eine gesetzliche Regelung hätte im Hinblick auf eine tatsächliche Freiwilligkeit Sicherheit schaffen und auch die Evaluation festschreiben können. Das ist nicht geschehen. Dies gilt es unbedingt nachzuholen. Die Humanistische Union fordert, dass eine klare gesetzliche Regelung zum Schutz der Grundrechte schnellstmöglich nachgeholt wird. Die Regelung muss mindestens enthalten:<\/p>\n

    \n
  • Die Regelung des Funktionsumfangs der App,<\/li>\n
  • die Sicherung auch der faktischen Freiwilligkeit der Nutzung der App,<\/li>\n
  • ein Verbot, Rechtsgeschäfte an die Nutzung der App zu knüpfen,<\/li>\n
  • die zeitliche Befristung der Nutzung der App auf die aktuelle Pandemie, zunächst für ein Jahr,<\/li>\n
  • die Verpflichtung zur Evaluation.<\/li>\n<\/ul>\n

    Mögliche Schluss­fol­ge­rungen<\/span><\/h2>\n

    Sicherheitspolitiker*innen werden Schlussfolgerungen aus dem Einsatz der App ziehen. Es besteht aus Sicht der Humanistischen Union das Risiko, dass durch den breiten Einsatz der App ein Gewöhnungseffekt eintritt und damit die Akzeptanz allgemeiner Überwachung gesteigert wird.
