Aus Anlass des aktuellen Gerichtsverfahrens gegen die Besetzung eines Konkordatslehrstuhls f&uuml;r Praktische Philosophie an der Universit&auml;t Erlangen (<a href=\"https:\/\/www.humanistische-union.de\/publikationen\/mitteilungen\/200\/\">s. Mitteilungen Nr. 200<\/a>, S. 24\/25) hatte Herr Ebert den EU-Kommissar f&uuml;r Besch&auml;ftigung, Soziales und Chancengleichheit, Vladimir &#352;pidla, auf die Widerspr&uuml;che zwischen den Ausschreibungsregeln dieser Lehrst&uuml;hle und der europ&auml;ischen Antidiskriminierungsrichtlinie hingewiesen.<\/p>\n<p>Mit Schreiben vom 13.2.2009 sicherte der EU-Kommissar eine eingehende Pr&uuml;fung zu. In dem Schreiben hei&szlig;t es:<\/p>\n<p>&#8222;<i>Wir sind zu dem Ergebnis gekommen, dass die bayerische Praxis hinsichtlich der Ernennung bestimmter Professoren an staatlichen, bayerischen Universit&auml;ten &#8230; der weiteren Aufkl&auml;rung durch die Bundesrepublik Deutschland bedarf. Diese Praxis beruht auf Artikel 3 Absatz 5 eines Vertrages vom 21. Oktober 1974 zwischen dem Freistaat Bayern und dem Heiligen Stuhl. Es scheint, dass die besondere Bedingung in diesem Vertrag, demzufolge diese Professoren vor einer Ernennung durch den Staat von dem zust&auml;ndigen Di&ouml;zesanbischof akzeptiert werden m&uuml;ssen, nicht in &Uuml;bereinstimmung mit der Richtlinie 2000\/78\/EG steht. Die Europ&auml;ische Kommission hat deshalb inzwischen ein Schreiben an die St&auml;ndige Vertretung der Bundesrepublik Deutschland bei der Europ&auml;ischen Union in Br&uuml;ssel gesandt, mit der Bitte, hinsichtlich der angesprochenen Ernennungspraxis zur Frage der Vereinbarkeit des oben genannten Vertrages vom 21. Oktober 1974 mit der Richtlinie 2000\/78\/EG Stellung zu nehmen.
