Wer auf über 40 Jahre Datenschutz und fast schon 20 Jahre Informationsfreiheit in Deutschland blickt, könnte annehmen, das Grundrecht auf informationelle Selbstbestimmung sei umzingelt von Freunden. Gerade die durchaus erfolgreiche Implementierung deutscher Datenschutzprinzipien in die jetzt maßgebliche EU-Datenschutzgrundverordnung (EU-DSGVO) könnte ebenfalls zu diesem Schluss verleiten. Und schließlich hat ja auch Baden-Württemberg seit Dezember 2015 „sein“ Informationsfreiheitsgesetz.<\/p>\n
Gerade an der Schwelle zum digitalen Zeitalter machen sich aber auch jene Kräfte verstärkt bemerkbar, die dem Anliegen des Datenschutzes schon immer reserviert bis feindselig gegenüberstanden: Behörden, die Sicherheitsinteressen in den Vordergrund schieben und meinen, es sei „jetzt nicht die Zeit für Daten- und Täterschutz“; Gerichte, die maßgebliche Normen des Datenschutzrechts ignorieren oder beiseite schieben; sog. Datenschutzexperten, die das Grundrecht schon immer für eine Fehlkonstruktion hielten, und natürlich jene Wirtschaftskräfte, die das „Grundrecht auf ökonomische Verwertung der persönlichen Daten anderer“ für vorzugswürdig halten. Und auch dem zarten Pflänzchen Informationsfreiheit ist vielfältige Gegnerschaft gewiss. Die soeben vor sich gehende Novellierung des Bundesdatenschutzgesetzes ist ein betrübliches Beispiel.<\/p>\n
Gründe genug und Zeit für eine nüchterne, aber wohl nicht hoffnungsfreie Bestandsaufnahme, die der oberste Datenschützer des Landes im Rahmen Vortragsreihe TACHELES vornehmen wird – wie schon vor ihm seine Vorgänger im Amt Jörg Klingbeil im Jahre 2013 und Peter Zimmermann im Jahre 2008.<\/p>\n
Zur Person: Seit dem 1. Januar 2017 ist Dr. Stefan Brink Landesbeauftragter für den Datenschutz und die Informationsfreiheit in Baden-Württemberg. Er wurde vom Landtag Baden-Württemberg für die Dauer von sechs Jahren gewählt. Von 2008 bis 2016 war er Leiter Privater Datenschutz beim Landesbeauftragten für den Datenschutz Rheinland-Pfalz, seit 2012 zugleich Stellvertretender Landesbeauftragter für die Informationsfreiheit Rheinland-Pfalz.<\/p>\n
