Die Enthüllungen Edward Snowdens haben das Ausmaß der internationalen Kommunikationsüberwachung deutlich gemacht. Menschenrechtsgremien und Nichtregierungsorganisationen haben wiederholt ihre Sorge geäußert und angemahnt, dass geheimdienstliche Eingriffe in das Recht auf Privatsphäre rechtmäßig, erforderlich und angemessen sein müssen, unabhängig von Nationalität oder Standort der Betroffenen. In Deutschland stehen Pläne zur Regulierung der Auslandsaufklärung des Bundesnachrichtendienstes auf der Tagesordnung, seit erhebliche Zweifel an der Legalität seiner Kommunikationsüberwachung im NSA-Untersuchungsausschuss deutlich wurden.<\/p>\n

Welche grund- und menschenrechtlichen Anforderungen sind dabei zu beachten? Sollte nur der Zugriff auf die Auslandskommunikation an den Kommunikationsknoten im Inland geregelt werden oder auch die Überwachung des Bundesnachrichtendienstes im Ausland? Reicht es, allein Bürgerinnen und Bürger aus befreundeten Staaten unter besonderen Schutz zu stellen oder gilt das grundgesetzlich geschützte Fernmeldegeheimnis weltweit? Und wie könnte eine Kontrolle der nachrichtendienstlichen Kommunikationsüberwachung ausgestaltet sein, die die Rechte Betroffener wirksam schützt?<\/p>\n
