Vortrag im Rahmen der Ringvorlesung „60 Jahre Grundgesetz – Anspruch und Wirklichkeit“<\/i><\/p>\n

Eine staatliche Neutralität in Religionsfragen sei im Grundgesetz gar nicht angelegt – so die Eingangsthese von Christoph Möllers. Und er fügte hinzu, dass eine solche Neutralität auch nicht wichtig sei. Staatliche Neutralität könne nicht die Vielfalt religiös-weltanschaulichen Lebens gewährleisten. Dass es keine Neutralität des deutschen Staates in religiösen Frage gebe, schade daher auch nicht der weltanschaulichen Pluralität unseres Landes. Wie sich jene dennoch entfalten konnte, und auf welchen anderen Begriff sich das Verhältnis von Staat und Kirchen\/Religionen möglicherweise bringen lässt, dies war Gegenstand des Vortrags von Christoph Möllers.<\/p>\n

Ausgangspunkt war einmal mehr der Parlamentarische Rat: Möllers verwies auf die kontroversen Debatten um das Erziehungsrecht der Eltern, die Bekenntnisschulen oder den Religionsunterricht an staatlichen Schulen. „Wenige Fragen waren im Parlamentarischen Rat so umstritten wie die Beziehung zwischen Staat und Kirche. Und Kirchen müssen wir sagen, nicht Religion, denn andere religiöse Akteure waren im Jahre 1948\/49 nicht in Sicht.“ Mit dem Ergebnis dessen, was den beiden Kirchen im Grundgesetz an Rechtsansprüchen garantiert wurde, könnten diese durchaus zufrieden sein – der komplette Bestand an Staatskirchenrechten aus der Weimarer Zeit wurde in die Bundesrepublik hinüber gerettet. Das staatskirchenrechtliche Verhältnis im Grundgesetz lasse sich aber nicht auf einen Nenner bringen, unsere Verfassung sei weder säkular, laizistisch oder neutral.<\/p>\n

Die christliche Schieflage des Religionsbegriffes unserer Verfassung wird auch in der Praxis der Religionsfreiheit deutlich. Die Religionsfreiheit sei, so Möllers, prozessual gesehen eines der erfolgreichsten Grundrechte. Die Crux an der Geschichte: Es waren vor allem die beiden Kirchen, die das Verfassungsgericht zu einem „ausgreifenden Verständnis der Religionsfreiheit“ verleiten und so ihre Sonderrechte erstreiten konnten. Klagten dagegen Vertreter religiös\/weltanschaulicher Minderheiten vor Gericht ihre positive oder negative Religionsfreiheit ein, waren sie zwar nicht weniger oft erfolgreich – allein die Gerichten fällten dann meist Einzelfallentscheidungen, die ausdrücklich keine verallgemeinerbare Lösung enthielten. Christoph Möllers pointierte den bundesrepublikanischen Umgang mit der Religionsfreiheit als „Minderheitenrecht zum Schutz von Mehrheitsmilieus“.<\/p>\n

PS: Die von Christoph Möllers eingangs aufgeworfene Frage, ob eine gemeinsame Veranstaltung der Humboldt-Universität mit der Humanistischen Union verfassungswidrig, weil mit einer weltanschaulichen Positionierung verbunden sei, stellt sich aus Sicht der Veranstalter nicht. Die Humanistische Union setzt sich für die strikte Trennung von Staat und Kirche ein, versteht ihren Humanismus aber nicht als Weltanschauung. Aus diesem Grund sind innerhalb der Humanistischen Union neben vielen Atheisten, Agnostikern und Christen auch Mitglieder verschiedenster Glaubensgemeinschaften organisiert.
