Juli 2006<\/p>\n<p>Der Landtag des Saarlandes hat folgendes Gesetz beschlossen:<\/p>\n<h5><span id=\"-1-anwendung-des-informationsfreiheitsgesetzes\">&sect; 1 Anwendung des Infor&shy;ma&shy;ti&shy;ons&shy;frei&shy;heits&shy;ge&shy;setzes <\/span><\/h5>\n<p>Jeder hat nach diesem Gesetz in entsprechender Anwendung der \u00a7\u00a7 1 bis 9 und 11 des Informationsfreiheitsgesetzes vom 5. September 2005 (BGBl. I S. 2722) in der jeweils geltenden Fassung gegen\u00fcber den Beh\u00f6rden des Landes, der Gemeinden und Gemeindeverb\u00e4nde einen Anspruch auf Zugang zu amtlichen Informationen. Satz 1 gilt auch f\u00fcr juristische Personen des \u00f6ffentlichen Rechts, soweit sie Grundrechtstr\u00e4ger sind und der Anspruch auf Informationszugang zur Aus\u00fcbung des jeweiligen Grundrechts geltend gemacht wird. F\u00fcr sonstige Organe und Einrichtungen des Landes, der Gemeinden und Gemeindeverb\u00e4nde und den Saarl\u00e4ndischen Rundfunk gilt dieses Gesetz, soweit sie \u00f6ffentlich-rechtliche Verwaltungsaufgaben wahrnehmen. F\u00fcr Forschungseinrichtungen, Hochschulen, Schulen und sonstige Bildungseinrichtungen sowie Pr\u00fcfungseinrichtungen gilt dieses Gesetz nur, soweit sie nicht im Bereich von Forschung, Lehre, Leistungsbeurteilungen und Pr\u00fcfungen t\u00e4tig werden.<\/p>\n<h5><span id=\"-2-schutz-von-besonderen-oeffentlichen-belangen\">&sect; 2 Schutz von besonderen &ouml;ffent&shy;li&shy;chen Belangen <\/span><\/h5>\n<p>Der Anspruch auf Informationszugang besteht nicht gegen\u00fcber dem Landesamt f\u00fcr Verfassungsschutz sowie den Beh\u00f6rden und sonstigen \u00f6ffentlichen Stellen im Lande und Teilen von diesen, soweit sie Aufgaben im Sinne des \u00a7 2 Abs. 1 Nr. 3 des Saarl\u00e4ndischen Sicherheits\u00fcberpr\u00fcfungsgesetzes vom 4. April 2001 (Amtsbl. S. 1182), zuletzt ge\u00e4ndert durch das Gesetz vom 15. Februar 2006 (Amtsbl. S. 474, 530), wahrnehmen.<\/p>\n<h5><span id=\"-3-rechtsbehelfsbelehrungspflicht\">&sect; 3 Rechts&shy;be&shy;helfs&shy;be&shy;leh&shy;rungs&shy;pflicht <\/span><\/h5>\n<p>Einer Entscheidung, die den Antrag ganz oder teilweise ablehnt, ist eine Erkl\u00e4rung beizuf\u00fcgen, durch die der Antragsteller \u00fcber den Rechtsbehelf, der gegen die Entscheidung gegeben ist, \u00fcber die Stelle, bei der der Rechtsbehelf einzulegen ist, und \u00fcber die Frist belehrt wird.<\/p>\n<h5><span id=\"-4-landesbeauftragter-fuer-informationsfreiheit\">&sect; 4 Landes&shy;be&shy;auf&shy;tragter f&uuml;r Infor&shy;ma&shy;ti&shy;ons&shy;frei&shy;heit <\/span><\/h5>\n<p>(1) Jeder kann den Landesbeauftragten f\u00fcr Informationsfreiheit anrufen, wenn er sein Recht auf Informationszugang nach diesem Gesetz als verletzt ansieht.<\/p>\n<p>(2) Die Aufgabe des Landesbeauftragten f\u00fcr Informationsfreiheit wird von dem Landesbeauftragten f\u00fcr Datenschutz wahrgenommen.<\/p>\n<p>(3) Die \u00a7\u00a7 25 bis 29 des Saarl\u00e4ndischen Datenschutzgesetzes vom 24. M\u00e4rz 1993 (Amtsbl. S. 286), zuletzt ge\u00e4ndert durch das Gesetz vom 27. Februar 2002 (Amtsbl. S. 498), in der jeweils geltenden Fassung gelten entsprechend.<\/p>\n<h5><span id=\"-5-gebuehren-und-auslagen\">&sect; 5 Geb&uuml;hren und Auslagen <\/span><\/h5>\n<p>F\u00fcr Amtshandlungen nach diesem Gesetz werden Geb\u00fchren und Auslagen nach dem Gesetz \u00fcber die Erhebung von Verwaltungs- und Benutzungsgeb\u00fchren im Saarland (SaarlGebG) vom 24. Juni 1964 (Amtsbl. S. 629), zuletzt ge\u00e4ndert durch das Gesetz vom 15. Februar 2006 (Amtsbl. S. 474, 530), in der jeweils geltenden Fassung erhoben.<\/p>\n<h5><span id=\"-6-in-kraft-treten-ausser-kraft-treten\">&sect; 6 In-Kraft-Treten; Au&szlig;er-&shy;Kraft-Treten <\/span><\/h5>\n<p>Dieses Gesetz tritt am Tag nach der Verk\u00fcndung in Kraft. Es tritt am 31.
