Akten­ein­sichts- und Infor­ma­ti­ons­zu­gangs­ge­büh­ren­ord­nung (AIGGebO)<\/h4>\n

Verwal­tungs­ge­büh­ren­ord­nung für Amtshand­lungen beim Vollzug des Akten­ein­sichts- und Infor­ma­ti­ons­zu­gangs­ge­set­zesvom 2. April 2001 (GVBl. II S. 85), zuletzt geändert durch Verordnung vom 19. Dezember 2005 (GVBl. II S. 596)<\/h5>\n

Auf Grund des § 10 Abs. 2 des Akteneinsichts- und Informationszugangsgesetzes vom 10. März 1998 (GVBl. I S. 46) verordnet die Landesregierung im Benehmen mit dem Ausschuss für Inneres des Landtages:<\/p>\n

§ 1 Gebührentarif<\/b><\/p>\n

Für Amtshandlungen beim Vollzug des Akteneinsichts- und Informationszugangsgesetzes werden Gebühren nachanliegendem Gebührentarif, der Bestandteil dieser Verordnung ist, erhoben.<\/p>\n

§ 2 Gebührenbemessung<\/b><\/p>\n

Bei der Festsetzung der Gebühr sind im Einzelfall zu berücksichtigender mit der Amtshandlung verbundene Verwaltungsaufwand, soweit Aufwendungen nicht als Auslagen gesondert berechnet werden, und auf Antrag die wirtschaftlichen Verhältnisse des Antragstellers.<\/p>\n

§ 3 Auslagen<\/b><\/p>\n

(1) Auslagen, die im Zusammenhang mit der gebührenpflichtigen Amtshandlung notwendig werden, gelten als bereits in die Gebühr einbezogen.<\/p>\n

(2) Absatz 1 gilt nicht, sofern das Akteneinsichtsrecht auf andere Weise als durch Einsicht in die Originaldokumente erfüllt wird (§ 7 Akteneinsichts- und Informationszugangsgesetz); hierfür notwendige Auslagen hat der Antragsteller zu ersetzen. Die Höhe der Auslagen bestimmt sich nach der Tarifstelle 3 der Anlage. Die Auslagen sind auch dann zu erstatten, wenn für eine Amtshandlung Gebührenfreiheit besteht oder von der Gebührenerhebung ganz oder teilweise abgesehen wird.<\/p>\n

§ 4 In-Kraft-Treten, Außer-Kraft-Treten<\/b><\/p>\n

Diese Verordnung tritt am Tage nach der Verkündigung in Kraft. <\/p>\n
