Die Diskussion um die verfassungsrechtliche Einordnung des neuen Computer-Grundrechtes konzentrierte sich auf die Frage, wie dessen objektivrechtliche Begr\u00fcndung im Verh\u00e4ltnis zu den traditionell subjektiv formulierten Abwehrrechten zu bewerten sei. Ein Vorteil jener Abwehrrechte sei es, dass man damit eine Definition gesellschaftlicher Freiheit vermeiden k\u00f6nne, was mehr Platz f\u00fcr unterschiedliche Vorstellungen individueller Freiheit lasse.<\/p>\n

Die hier wiedergegebene Diskussion fand auf der Fachtagung „Online-Durchsuchungen. Konsequenzen des Karlsruher Richterspruchs“ statt, die die Humanistische Union gemeinsam mit der Friedrich-Naumann-Stiftung am 28. April 2008 in Berlin veranstaltete.
