Es gibt Verfassungsgebote, die sind \u00e4lter als das Grundgesetz, sind eindeutig und unmissverst\u00e4ndlich formuliert \u2013 und werden dennoch nicht beachtet. Dazu geh\u00f6rt die Abl\u00f6sung der sog. Staatsleistungen, die j\u00e4hrlich an die Kirchen entrichtet werden. Diese Leistungen werden, so die g\u00e4ngige Begr\u00fcndung, als Entsch\u00e4digung f\u00fcr Enteignungen im Zuge der S\u00e4kularisation ehemaligen Kirchenbesitzes gezahlt, zum Teil schon seit 1817. Bereits 1919 legte die Weimarer Reichsverfassung fest: „Die auf Gesetz, Vertrag oder besonderen Rechtstiteln beruhenden Staatsleistungen an die Religionsgesellschaften werden durch die Landesgesetzgebung abgel\u00f6st. Die Grunds\u00e4tze hierf\u00fcr stellt das Reich auf.<\/i>“ (Artikel 138 Abs. 1 WRV) Die Bestimmungen der Weimarer Reichsverfassung wurden 1949 \u2013 da noch nicht erf\u00fcllt \u2013 \u00fcber Artikel 140 in das Bonner Grundgesetz \u00fcbernommen.\u00a0 Seitdem harren sie ihrer Umsetzung…<\/p>\n
Carsten Frerk stellte in seinem Vortrag bei den Berliner Gespr\u00e4chen nicht nur die g\u00e4ngige historische Begr\u00fcndung f\u00fcr die Staatsleistungen in Frage – die Entsch\u00e4digung f\u00fcr S\u00e4kularisationen von Kircheneigentum, insbes. durch den Reichsdeputationshauptschluss. Er erinnerte auch daran, dass die Kirche jene Besitzt\u00fcmer selbst vielfach auf undemokratische Art und Weise erworben habe. Es fehlten daher sowohl die rechtlichen wie die moralischen Gr\u00fcnde f\u00fcr Entsch\u00e4digungszahlungen an die Kirchen.<\/p>\n
