Abschiebungshaft ist eine reine Verwaltungsma\u00dfnahme, der keine Verurteilung wegen einer Straftat zugrunde liegt. Nicht nur deshalb steht die Abschiebungshaft schon lange und aktuell wieder massiv in der Kritik.<\/p>\n

In den letzten Jahren waren bis zu 80 Prozent aller Inhaftierten Fl\u00fcchtlinge, die von der Bundespolizei aufgegriffen und in Haft gebracht wurden, bevor sie Gelegenheit hatten, einen Asylantrag zu stellen. In rund der H\u00e4lfte aller gerichtlich \u00fcberpr\u00fcften Haftanordnungen stellte sich sp\u00e4ter heraus, dass diese teilweise oder vollst\u00e4ndig rechtswidrig waren. Das sind nur zwei von vielen alarmierende Befunden, die in der Textsammlung „Haft ohne Straftat – Fakten und Argumente gegen Abschiebungshaft“ beschrieben werden.<\/p>\n

Die HerausgerInnen zeigen mit dem Buch landes- und kommunalpolitische M\u00f6glichkeiten auf, wie die Haftanordnungen stark reduziert werden k\u00f6nnen. Die Brosch\u00fcre liefert politische und rechtliche Argumente f\u00fcr die Abschaffung von Abschiebungshaft, wie sie derzeit von den Landesregierungen in Schleswig-Holstein und Rheinland-Pfalz angestrebt wird.<\/p>\n

FALLBEISPIEL<\/span><\/h2>\n

Der pakistanische Fl\u00fcchtling Usman M. sitzt zwei Monate in der Abschiebungshaftanstalt Eisenh\u00fcttenstadt, bevor er am 23. Juni 2013 nach Ungarn zur\u00fcckgeschoben werden soll. Die Abschiebung misslingt, weil ein Mitreisender sich im Flugzeug nicht setzen will, solange ein Mensch zwangsweise an Bord ist. Anschlie\u00dfend kommt Usman M. wieder in Haft, wo er in den Hungerstreik tritt. Am 26. Juli setzt das Verwaltungsgericht Frankfurt\/Oder die R\u00fcckf\u00fchrung nach Ungarn wegen systemischer M\u00e4ngel im dortigen Asylverfahren aus. Nach drei Monaten Haft und einem gescheiterten Abschiebeversuch wird Usman M. entlassen und kann sein Asylverfahren in Deutschland betreiben. Die Anw\u00e4ltin hat Haftentsch\u00e4digung beantragt und erw\u00e4gt strafrechtliche Schritte wegen Freiheitsentziehung.<\/p>\n
