Beschlussempfehlung des Rechtsausschusses<\/b><\/p>\n

Der Bundestag wolle beschließen,<\/p>\n

in Kenntnis der Unterrichtung – Drucksache 15\/3696 Nr. 2.15 – folgende Entschließung anzunehmen:<\/p>\n

Der Deutsche Bundestag erinnert an seine bei der Novellierung des Telekommunikationsgesetzes zum Ausdruck gekommene Ablehnung einer Mindestspeicherungsfrist für Verkehrsdaten und fordert die Bundesregierung auf, dies zur Grundlage ihrer Verhandlungen auf EU-Ebene zu machen. Der Europäische Rat hat am 25. März 2004 den Rat beauftragt, Vorschläge für Rechtsvorschriften über die Aufbewahrung von Verkehrsdaten durch Diensteanbieter zu beraten. Der Deutsche Bundestag geht dabei davon aus, dass derartige Rechtsvorschriften ihre Rechtsgrundlage im Bereich der „dritten Säule“ finden würden. Sollten in den anstehenden Beratungen Rechtstatsachen dargelegt werden, die aus Sicht der Bundesregierung eine Überprüfung der im Rahmen der Beratungen zum Telekommunikationsgesetz eingenommenen Position des Deutschen Bundestages in dieser Frage notwendig erscheinen lässt, erwartet der Deutsche Bundestag eine unverzügliche Information seiner zuständigen Gremien, damit er Gelegenheit hat, eine erneute Stellungnahme gegenüber der Bundesregierung im Rahmen der Mitwirkungsrechte nach Artikel 23 des Grundgesetzes abzugeben, die die Bundesregierung dann ihren weiteren Verhandlungen zugrunde legen wird.<\/p>\n
